NOTICE OF DESIGN PUBLIC HEARING

CITY OF BATAVIA

CO-SPONSOR: NEW YORK STATE DEPARTMENT OF TRANSPORTATION

PROJECT IDENTIFICATION NO. 4034.52

 

 

     In accordance with the provisions of Title 23, U.S. Code, Section 128 and Title 40, Code of Federal Regulations, Parts 1500 to 1508; a design public hearing (open house) will be conducted by the City of Batavia and the New York State Department of Transportation at 16 Genesee Country Mall (formerly Sleght’s) on August 15, 2002.  An open forum will be held from 4:00 pm to 6:30 pm.  Displays and information tables will be staffed by City of Batavia and Department representatives who are available to answer questions.  During this time, comments, either written or oral, may be presented to a stenographer on an individual basis for inclusion into the official public record.  In addition, a formal hearing will begin at 7:00 pm for individuals wishing to make their comments in public.  Responses to questions or comments will not be provided during the formal hearing.  However, comments will be recorded by a stenographer for inclusion in the official public record.  Discussions will center on the proposed Reconstruction of the NY Route 5, Main Street, located in the City and Town of Batavia, Genesee County.

 

     Design plans for the project have been developed by the City of Batavia after coordination with Federal, State and local agencies and will be available for inspection at the public open house.  City and New York State Department of Transportation engineers will be available during the open forum (between 4:00 pm and 6:30 pm) to discuss the project and answer any questions.

 

     Tentative schedules for right-of-way acquisition and construction will be available.  Information will also be available regarding the process by which the City acquires property for public purposes.  It is anticipated that property relocations will not be required for this project.

 

     Maps, drawings and other pertinent information developed by the City and written views received as a result of the coordination with Federal, State and local agencies will be available for public inspection and copying at City Hall, One Batavia City Centre, Main Street, Batavia, New York, 14020.

 

     All interested persons will be given the opportunity to express their views concerning the economic and social effects of the design plans, their impact on the environment and their consistency with the goals and objectives of such planning as has been promulgated by the community.  The proceedings will be recorded.  Persons may file written statements and other exhibits in place of or in addition to oral statements made at the public hearing.  Written statements submitted at the hearing or mailed and received before August 15,  2002 at the City of Batavia’s Bureau of Engineering will be made part of the record.
