Pedestrian Way Notice to Bidders

CITY OF BATAVIA LEGAL NOTICE NOTICE TO BIDDERS

NOTICE IS HEREBY GIVEN, that pursuant to the requirements of Section 103 of the General Municipal Law, sealed proposals will be received at City of Batavia Clerk's Office, City Hall, One Batavia City Centre, Batavia, NY 14020, until the 11th day of April 2019 at 10:00 AM prevailing time, for furnishing:

PEDESTRIAN WAY IMPROVEMENTS

to be let by the City of Batavia according to the plans and specifications prepared by LaBella Associates, DPC. All bids will be publicly opened and read in the City Council Chambers at the date, time and location above.

Work to be Done: The project will replace existing sidewalks and provide new ADA compliant ramps as noted below:

State Street – Washington to Richmond (both sides of the street) and Hart to MacArthur (east side of the street)

Washington Avenue – State to Bank (both sides of the street)

Richmond Avenue – Ellicott to State (south side of the street)

Bank Street - Washington to North (east side of street) and North to Denio (west side of the street)

Also included in the project are signal improvements at the Richmond / State intersection.

Prospective bidders should note that this project is intended for construction in the spring and summer of 2019.

The enclosure containing the sealed proposal shall be endorsed on the outside with the name of the bidder, the business address to which communications may be sent, and the material to be furnished pursuant to this notice.

Copies of the Contract Documents, including drawings and technical specifications, are available on a CD-ROM from the City Clerk's Office upon payment of fifteen dollars ($15.00) per CD­ ROM. If the CD-ROM is to be mailed, add ten dollars ($10.00) per CD-ROM to cover the cost of packaging and postage. Checks shall be made payable to the City of Batavia. For Contract Documents that are mailed, the mailing date will be considered the Bidder's date of receipt. Paper copies of the Contract Documents will be made available upon request only. A fee of $75.00 +

$30.00 for packaging and mailing is required for each paper copy. All prospective bidders shall obtain bid documents from the City. The City of Batavia does not guarantee either the accuracy or completeness of bid documents obtained from sources other than the City. Only those prospective bidders who have purchased Contract Documents from the City will be sent all addenda.

Copies of the above described Contract Documents may be examined free of charge at the City Clerk's Office of the City of Batavia, One Batavia City Centre, Batavia, NY 14020 and the office of LaBella Associates, DPC, 300 State Street Suite 201, Rochester, New York 14614.

Each bid must be accompanied by cash, certified check, or a bid bond in an amount not less than 5% of his/her bid in the form, and subject to the conditions set forth in the Contract Documents and Instructions for Bidders.

The successful bidder must be an equal opportunity employer, must meet all appropriate Federal standards, and comply with all relevant Federal regulations. This federal transportation funded contract has a 0% Disadvantaged Business Enterprise goal, and workforce participation goals of 5.9% Minority and 6.9% Female. The successful bidder must also have on file with New York State a valid NYS Uniform Contractors Questionnaire.

Bidders are advised that a pre-bid conference will not be held for the project.

Upon acceptance of his/her bid, if the successful bidder fails to enter into a contract pursuant to the requirements of said agency, then the sum deposited as aforesaid shall be forfeited to the City of Batavia as liquidated damages, or the payment of the bond enforced for the benefit of the City of Batavia.

A bidder can withdraw their bid after the opening of the bids (only) under the terms described in Section 102-07 of the NYSDOT Standard Specifications.

The successful bidder must furnish 100% Performance Bond and 100% Labor and Materials Bond, and shall comply with the requirements of Chapter 617 of the Laws of New York State for 1974.

The City of Batavia is exempt under Section 1116 of the Tax Law, and therefore no sales tax shall be included in the bid.

No bids shall be accepted from, or any contract awarded to any person or corporation who is in arrears to the City of Batavia upon any debt of Contract, or is a defaulter as surety or otherwise upon obligation to the City of Batavia.

The City of Batavia reserves the right to consider bids for sixty (60) days after their receipt before awarding any contract(s). In addition, the City of Batavia reserves the right to reject all bids if the bids are higher than available funding, or if the City determines that it is not in their best interest to continue with the project. The City can reject bids which are deemed to be unbalanced; if the materials are not filled out completely; if it appears that the Contractor cannot perform the work; or if the Contractor is unresponsive.
